§ 1. General provisions
- The Terms set out the rules for using the VetLek app: the types and scope of services provided by electronic means, the conditions for concluding and terminating contracts for the provision of those services and the procedure for submitting and handling complaints. They are the terms and conditions (regulamin) referred to in art. 8 of the Act of 18 July 2002 on the provision of services by electronic means (ustawa o świadczeniu usług drogą elektroniczną).
- The Provider is Mateusz Stopinski, running a sole proprietorship under the business name Mateusz Stopinski, entered in the Central Register and Information on Business Activity (Centralna Ewidencja i Informacja o Działalności Gospodarczej, CEIDG) maintained by the minister responsible for the economy, address: Dobieszewice 7a, 88-170 Pakość, NIP 5562821087, REGON 544391580 (hereinafter: the Provider).
- Contact with the Provider: e-mail [email protected], telephone +48 574 386 150, by post to the address given in paragraph 2, and in matters concerning the Account also in the App (Settings → Write to us).
- The Terms are made available free of charge before the contract is concluded - in the App (Settings → Account details, password, logging out → Terms and privacy) and on the website vetlek.pet/regulamin - in a manner that allows them to be obtained, reproduced and recorded (saved or printed).
- The rules for processing personal data are described in the Privacy Policy, available in the same places.
§ 2. Definitions
- App - the VetLek application available in a web browser at app.vetlek.pet, as an application for devices running Android, downloaded from the website vetlek.pet or from Google Play, and as an application for the iPhone running iOS, downloaded from the App Store.
- User - an adult natural person who has created an Account.
- Consumer - a User who is a consumer within the meaning of art. 22¹ of the Civil Code (Kodeks cywilny).
- Entrepreneur with Consumer Rights - a natural person concluding a contract directly related to their business activity, where the content of the contract shows that the contract is not of a professional nature for that person, such nature arising in particular from the subject of the business activity they conduct, as made available in CEIDG. The provisions of the Terms concerning Consumers apply to that person to the extent set out in art. 385⁵ of the Civil Code and in art. 7aa and art. 38a of the Act of 30 May 2014 on consumer rights (ustawa o prawach konsumenta).
- Account - the set of the User’s data and settings in the App, accessible after logging in.
- SmPC - the Summary of Product Characteristics of a Veterinary Medicinal Product and other documents from the Register of Medicinal Products maintained by the President of the Office for Registration of Medicinal Products, Medical Devices and Biocidal Products (URPL) and from the Union Product Database of the European Medicines Agency (EMA).
- Content - information made available in the App, in particular product registration data, dosings and other information transcribed from SmPCs, SmPC texts, comparisons of their versions and the results of the tools.
- Basic Access - the access every User has: the product catalogue with registration data and links to source documents, clinical tools operating on values entered by the User, and the full Content of 10 products selected by the User.
- Full Access - access to the Content of all products: dosings with the conversion of the dose into the amount of product, key information, full SmPC texts, version comparisons and saving for work without the internet, available under § 7.
- Partner - an entity which, through the App, presents advertisements, offers, product samples or training courses.
§ 3. Types and scope of services
- The Provider provides the following services by electronic means: a) maintaining the Account; b) making available a catalogue of veterinary medicinal products with registration data and links to source documents; c) making available clinical tools operating on values entered by the User, including the conversion of a dose from the SmPC into the amount of product; d) making available Content transcribed from SmPCs - with Basic Access or with Full Access (§ 7); e) saving the product database and SmPC texts on the device, for use without internet access; f) receiving reports of errors, questions and proposed corrections; g) at the User’s request - a weekly e-mail about changes in SmPCs, containing one labelled sponsored message from a Partner, and browser notifications about new SmPC versions of favourite and recently opened products; h) presenting Partners’ offers and forwarding the User’s requests to them with the User’s consent; i) the “Sprawdzaj” (“Check”) programme, if it is available for the Account.
- All services are provided free of charge. The contract for the provision of the services is concluded upon creation of the Account, for an indefinite period. The App is financed by Partners’ advertisements and offers (§ 9).
- The App is intended primarily for veterinarians, veterinary technicians and veterinary students. The Content is professional information and does not replace the advice of a veterinarian. A User who is not a veterinarian should not treat animals on their own on the basis of the Content; prescription-only veterinary medicinal products are to be used only in accordance with the recommendation of a veterinarian.
§ 4. Technical requirements and risks
- To use the App, the following are needed: a device with internet access - when creating an Account, logging in and downloading data (saved data also work without the internet, and the App starts without a connection for no more than 30 days from the last connection to the server); an up-to-date version of the Chrome, Edge, Firefox or Safari browser with JavaScript, cookies and browser storage enabled, or a device running Android 7.0 or later (with the app downloaded from the website vetlek.pet or from Google Play), or an iPhone running iOS 15.0 or later (with the app downloaded from the App Store); an active e-mail account.
- The product database saved on the device may take up from a few to several dozen megabytes; the App shows its estimated size before saving.
- Using services over the internet involves risks, in particular malware, the obtaining of passwords by deception through fake websites or messages (phishing) and access by unauthorised persons to an unsecured device. The Provider never asks for a password by e-mail or by telephone. The User should keep the operating system and browser up to date, use a strong password that they do not use on other services, and protect the device with a screen lock - patient data and Content are saved on the device.
- The Provider encrypts connections to the App (HTTPS) and applies the security measures described in the Privacy Policy.
- The function and purpose of the data saved by the App on the User’s device (browser or app storage, session cookie or session token) are described in the Privacy Policy (point 5).
§ 5. Account
- Using the App requires an Account. Creating an Account requires providing an e-mail address and a password, accepting the Terms and confirming the e-mail address by means of the link in a message. Before obtaining access to the Content, the User completes basic information about themselves (first name and surname, profession, type of workplace) and confirms the “Important before use” rules (§ 6(7)).
- The User shall provide true and up-to-date data. The Account is personal and must not be shared with other persons. One person may have one Account.
- The User shall protect their password and is responsible for actions performed on the Account, unless they are not at fault. The Provider must be notified without delay of any suspected takeover of the Account.
- One Account may be logged in on no more than 5 devices at the same time; logging in on a further device logs out the device that was used least recently.
- A veterinarian may provide their licence to practise number (PWZ) together with their first name and surname as they appear in the register of the veterinary chamber, and a veterinary student - an e-mail address in the domain of their university. The Provider checks the PWZ number manually in the public register of the competent chamber; student status is confirmed by a link sent to the university address. Confirmation of the PWZ is valid for 12 months, with 30 days for re-verification, and confirmation of student status - for 12 months. A PWZ number provided or a confirmed student status entitles the User to Full Access under § 7(3), and a confirmed PWZ number - also to offers and advertisements intended for veterinarians. One PWZ number and one university address may confirm only one Account. A change of first name or surname after confirmation of the PWZ requires re-verification.
- The User may at any time, without observing any notice period and at no cost, terminate the contract for maintaining the Account by deleting the Account in the App (Settings → Account details, password, logging out → Delete account) or by requesting its deletion in a message sent from the Account’s e-mail address. A Consumer and an Entrepreneur with Consumer Rights may also withdraw from the contract within 14 days of its conclusion, without giving any reason and at no cost - by deleting the Account or by sending the Provider an unequivocal statement, e.g. by e-mail to [email protected] (the model form set out at the end of the Terms may be used, but this is not obligatory). The data that remain after deletion of the Account and their retention periods are described in the Privacy Policy.
- The Provider may terminate the contract for important reasons, subject to a 30-day notice period, by notifying the User by e-mail. Important reasons are: the cessation of the provision of the services in whole or in the part to which the contract relates; a change in the law that makes further provision of the services impossible; persistent breach of the Terms by the User despite a request to cease the breaches.
- The Provider may block the Account or restrict access to its functions with immediate effect where the User: shares the Account with other persons; downloads Content in bulk or automatically; circumvents security measures, limits or the rules of Basic Access; has provided false data in order to obtain Full Access; posts unlawful content; disrupts the operation of the App. The Provider provides the User with a statement of reasons for the decision, unless this is prohibited by law, and the User may appeal against the decision (§ 11(5)). The blocking or restriction lasts until the matter is clarified, for no longer than 30 days; if the breach is confirmed, the Provider may terminate the contract with immediate effect, and if it is not confirmed - the Provider restores access without delay.
§ 6. Nature of the Content and liability
- VetLek serves information and educational purposes only. The Content comes from official public sources: the Register of Medicinal Products (Rejestr Produktów Leczniczych) maintained by the President of URPL and the Union Product Database maintained by EMA. Each item of information is accompanied by a link to the source document.
- The Content is transcribed from SmPCs and other registration documents automatically, using IT tools, including artificial intelligence; part of it is additionally compared with the SmPC by a human (marked “✓ SmPC”). The Content may contain errors or be incomplete or out of date.
- The results of the tools (including the conversion of the dose into the amount of product, infusions, fluid therapy, anaesthesia and CPR) are auxiliary calculations performed on the basis of data entered by the User. They are not a recommendation, advice or an indication of a method of treatment. The results of the tools must always be verified against the official, current SmPC in the Register of Medicinal Products (URPL).
- The App is an information and support tool. It is neither a veterinary service nor veterinary medical advice and does not replace an examination of the animal. VetLek does not make therapeutic decisions for the User and does not select the dose. The decision on treatment, the choice of product, the dose, the route of administration and the duration of treatment is made solely by the veterinarian - on the basis of the current SmPC, the patient’s condition and their own knowledge. Before a product is used, the dose must be checked in the current SmPC.
- The App is intended for veterinary use and is not a medical device within the meaning of Regulation (EU) 2017/745.
- Markings originating from other Users (e.g. “confirmed by veterinarians”) express their assessment and do not guarantee correctness.
- Before starting to use the Content, the User confirms that they have read the rules set out in paragraphs 1-4 (“Important before use”). Each acceptance of the Terms and of those rules is recorded together with the date, the version of the documents, a hash of their content, the IP address and information about the browser.
- The Provider exercises due diligence to ensure that the Content corresponds to the SmPCs and corrects reported errors without delay - with priority given to errors concerning dosing.
- The Provider makes efforts to ensure that the App operates without interruption. It may temporarily restrict access due to technical work, updates or failures, giving advance notice of planned interruptions where possible. Content saved on the device also works during an interruption.
- In relation to a User who is neither a Consumer nor an Entrepreneur with Consumer Rights, the Provider’s liability for non-performance or improper performance of the contract - given that the services are free of charge - is limited to actual loss. The limitation does not apply to damage caused intentionally or through gross negligence.
- In relation to Consumers and Entrepreneurs with Consumer Rights, the Provider is liable on the terms laid down by law. No provision of the Terms excludes or limits their rights under provisions that cannot be excluded or limited by contract.
§ 7. Access to the Content
- The Provider charges Users no fees and does not sell access to the App. Using the App in accordance with the Terms gives rise to no obligation to pay.
- Every User has Basic Access. The product shown in the tutorial does not count towards the 10 products of Basic Access. The limit of 10 products is available once per e-mail address, including after the Account has been deleted and created again.
- Full Access is available free of charge to: a) a veterinarian who has provided a PWZ number (§ 5(5)) - immediately after providing it, while the number is waiting to be checked in the public register of the veterinary chamber, and once it is confirmed - for the period of validity of the confirmation, renewed after re-verification every 12 months; if the number cannot be confirmed, the Account returns to Basic Access, and a further number gives Full Access only once it is confirmed; b) a veterinary student who has confirmed their status with a university e-mail address (§ 5(5)) - for 12 months from the confirmation.
- Other Users have Basic Access. They may ask for Full Access in the App (“Ask for access”), briefly describing who they are; the Provider considers each request individually and replies to the Account’s e-mail address.
- The Provider may, at its discretion, also grant Full Access to other persons, in particular to Partners and to persons reviewing the App for app stores, for a period determined by the Provider.
§ 8. Complaints and conformity of the services with the contract
- The Provider is obliged to supply the Content and services in conformity with the contract. In relation to Consumers and Entrepreneurs with Consumer Rights, the Provider is liable for any lack of conformity of digital content and digital services with the contract under the rules of Chapter 5b of the Consumer Rights Act, including by ensuring the updates necessary to keep them in conformity with the contract for the duration of the contract.
- A complaint, e.g. concerning lack of access or the operation of the App, may be submitted by e-mail to [email protected], in writing to the Provider’s address or in the App (Settings → Write to us). For the complaint to be handled efficiently, it is advisable to state the Account’s e-mail address, a description of the problem, the date on which it occurred and the expected manner of resolving the matter.
- The Provider responds to a complaint within 14 days of its receipt, to the Account’s e-mail address or to another address indicated in the complaint. If the Provider does not respond to a Consumer’s complaint within that time limit, the Provider is deemed to have accepted the complaint.
- If the digital content or digital service is not in conformity with the contract, the Consumer may demand that it be brought into conformity with the contract. If bringing it into conformity is impossible, requires excessive costs, has not taken place within a reasonable time or the lack of conformity is significant, the Consumer may submit a statement of withdrawal from the contract - under the rules of Chapter 5b of the Consumer Rights Act.
- In relation to Users who are neither Consumers nor Entrepreneurs with Consumer Rights, liability under the statutory warranty (rękojmia) is excluded.
- The Consumer may use out-of-court methods of handling complaints and pursuing claims, in particular the assistance of a municipal or district (powiat) consumer ombudsman or of consumer organisations, and mediation or a permanent consumer arbitration court attached to the voivodeship inspectorate of the Trade Inspection (Inspekcja Handlowa). Information on these methods is available at www.uokik.gov.pl. When refusing to accept a complaint, the Provider states whether it agrees to the out-of-court resolution of the dispute.
§ 9. Advertisements and Partners’ offers
- The App may display Partners’ advertisements and VetLek information, labelled respectively as “Sponsored” or “From VetLek” and separated from the Content. An advertisement never changes the Content, dosings or the results of the tools and does not appear in search, in the conversion of a dose into an amount, in the clinical tools, in the SmPC text or next to the patient. One labelled advertising strip may be shown above the product list. A product card and its version history may show labelled materials of the manufacturer of that product and, where there are none, labelled advertisements of Partners that do not concern medicinal products.
- When the App is launched, a full-screen advertisement may appear - no more than once an hour on a given device, lasting no more than 5 seconds, and with the option of skipping it immediately. It does not appear when the App opens directly on tools, e.g. CPR.
- Advertisements are selected according to the placement in the App, the context of the screen (the matching is performed by the User’s device - information about what the User is viewing is not sent to the server for this purpose) and - unless the User has switched this off - the data from the Account: profession, PWZ confirmation, type of workplace and species treated. For each advertisement, “Why am I seeing this?” shows who pays for it and why it was displayed. Matching to the data from the Account can be switched off at any time in Settings → Ads - the User will then see only advertisements addressed to everyone. An advertisement can be hidden on the device and reported to the Provider, e.g. as misleading or unlawful.
- Advertisements and offers concerning prescription-only veterinary medicinal products - in the App and in e-mails - are addressed exclusively to veterinarians with a confirmed PWZ number (art. 120 of Regulation (EU) 2019/6). The Partner is responsible for the conformity of the content of the advertisement with the SmPC and with the provisions on the advertising of veterinary medicinal products, which does not exclude the Provider’s liability under the law. Partners do not receive Users’ personal data in connection with advertisements - only aggregate statistics.
- Partners’ offers (samples, contact with a representative, training courses) are labelled as sponsored. A request to a Partner requires the User’s consent to the transfer of the indicated data to that Partner, given separately for each company and purpose; before sending, the User sees exactly what data will be transferred.
- The Partner is responsible for the product, sample, contact and training course. The Provider forwards the User’s request to the Partner for a fee and is not a party to the contract between the User and the Partner.
- Samples of veterinary medicinal products may be ordered only by veterinarians with a confirmed PWZ number; samples are provided by the Partner in a manner compliant with art. 119 of Regulation (EU) 2019/6. Samples of antimicrobial veterinary medicinal products are not offered.
- E-mails from VetLek Partners are sent by the Provider - only with the User’s consent, no more than 2 per calendar month, with the option of unsubscribing with one click. Partners do not receive the User’s e-mail address.
§ 10. The “Sprawdzaj” (“Check”) programme
- If the “Sprawdzaj” programme is available for the Account, the User may voluntarily help verify dosings: in the App they compare a dosing with the SmPC and confirm it or point out a correction.
- Participation in the programme is voluntary and unpaid. No remuneration, points, rewards or other benefits are given for answers. Participation may be ended at any time by no longer answering.
- The number of answers per day is limited. The daily limit is stated in the App and may depend on how far the User’s earlier answers conformed with the SmPC.
- Answers are checked, in particular by means of control questions with a known answer. A correction pointed out becomes part of the Content only after it has been checked by the Provider; § 11(2) applies to answers and corrections.
- Participation in the programme is automatically suspended until the next day where answers are given too quickly, and until the matter is clarified where a significant proportion of the answers to control questions do not conform with the SmPC. The Provider may also suspend the Account’s participation in the programme where the answers indicate automated or random activity. The User is informed in the App of the suspension and its reason and may appeal against it (§ 11(5)).
- The Provider may change the rules of the programme or end it, informing participants in the App.
§ 11. User content, reports and moderation
- The User may report errors, ask questions (Write to us) and propose corrections to the Content. A proposed correction is reviewed by the Provider and, once accepted, becomes part of the Content, without the author being identified to other Users.
- By submitting a proposed correction, the User declares that they are entitled to dispose of it and grants the Provider a free-of-charge, non-exclusive, territorially unlimited licence, for an indefinite period, to use it in the VetLek database, in the following fields of exploitation: recording and reproduction by any technique, entry into computer memory and into a network, adaptation (including editorial changes and combination with other Content) and making available to the public in the App and on the website vetlek.pet, with the right to grant further licences to entities providing services to the Provider.
- It is prohibited to submit content that is unlawful, offensive, misleading or advertising (spam) or that infringes the rights of other persons, as well as personal data of animal owners and other third parties.
- Anyone may notify the Provider of content or an advertisement in the App which they consider to be illegal - in the App (Report ad, Report an error) or by e-mail to [email protected]. The notice should contain an explanation of why the content is illegal, an exact indication of the content (e.g. the product name and the location in the App), the first name and surname and the e-mail address of the notifier (this does not apply to notices of content that may constitute offences referred to in art. 3-7 of Directive 2011/93/EU) and a statement that the notifier is acting in good faith and that the information provided is accurate and complete. The Provider confirms receipt of the notice, processes it without undue delay in an objective and non-arbitrary manner and notifies the notifier of the decision and of the possibility of appeal.
- Where the Provider removes the User’s content, restricts access to it or blocks or restricts the Account, the Provider provides the User with a statement of reasons in accordance with art. 17 of Regulation (EU) 2022/2065 (Digital Services Act). The User may appeal against the decision within 6 months, by e-mail to [email protected]; the Provider re-examines the matter and responds within 14 days. This does not exclude the right to pursue claims before a court. The User may also lodge a complaint with the Digital Services Coordinator (art. 53 of the Digital Services Act).
- Reports, proposals and User content are reviewed by a human. Limits protecting against abuse (e.g. the daily limit on reading full SmPC texts and the limit on the number of reports over time) and the mechanisms of the “Sprawdzaj” programme described in § 10(3) and (5) operate automatically. Any such restriction may be appealed under paragraph 5.
- The point of contact for Users and for the authorities of the Member States, the European Commission and the European Board for Digital Services (art. 11 and 12 of the Digital Services Act) is the e-mail address [email protected]. Communication is possible in Polish or in English.
§ 12. Permitted use and intellectual property
- The App, its software, the arrangement and selection of the Content and the VetLek database are protected by law, in particular by the Act on copyright and related rights (ustawa o prawie autorskim i prawach pokrewnych) and the Act on the protection of databases (ustawa o ochronie baz danych). SmPC texts and registration data come from the public registers of URPL and EMA; the Provider does not claim exclusive rights to them. The data of the Register of Medicinal Products are published by Centrum e-Zdrowia on the dane.gov.pl portal (https://dane.gov.pl/en/dataset/397) under the Creative Commons Attribution 4.0 International licence (CC BY 4.0, https://creativecommons.org/licenses/by/4.0/legalcode); the Provider processes them in the App (layout, search, reading of the dosings from the SmPC). Information of the European Medicines Agency (EMA) is shown in the App with EMA named as the source.
- Under the contract, the User receives a non-exclusive and non-transferable licence to use the App and the Content for their own professional, educational or personal purposes, for the duration of the contract.
- The following are prohibited: bulk or automated downloading of the Content, copying a substantial part of the database, making the Content or the Account available to third parties, circumventing security measures, limits and the rules of Basic Access (including creating additional Accounts) and interfering with the operation of the App. To protect the database, limits apply to the reading of full SmPC texts: 300 per day and 60 within 10 minutes per Account, which is sufficient for ordinary use.
§ 13. Amendments to the Terms
- The Provider may amend the Terms for important reasons, which are: a change in the law or a decision of an authority or a court; a change in the scope, functions or manner of providing the services, including the introduction of new functions or a change in the rules of access to the Content; a change of service providers; the need to increase security or to prevent abuse; the need to clarify provisions that give rise to doubts.
- The Provider makes the new version of the Terms available in the App and on the website vetlek.pet and informs Users of it when the App is next launched.
- The amended Terms bind the User from the moment they are accepted in the App. A User who does not accept the amendments may terminate the contract with immediate effect by deleting the Account.
§ 14. Final provisions
- Polish law applies to contracts concluded on the basis of the Terms. The choice of law does not deprive the Consumer of the protection afforded to them by those provisions of the law of the country of their habitual residence that cannot be excluded by contract.
- Disputes with Users who are neither Consumers nor Entrepreneurs with Consumer Rights are resolved by the court competent for the place where the Provider conducts its business. Disputes with Consumers are resolved by the court competent under the general provisions.
- Contracts are concluded in Polish. Translations of the Terms are for information purposes only.
- The Terms are effective from 16 October 2026. The Provider makes previous versions available on request.
